Litigation

Various state and federal laws govern conduct in the workplace, as do collective bargaining agreements for unionized places of employment. Myers & Myers is experienced with all aspects of labor and employment litigation, including pre-litigation agency charges, trials, and appeals. Common employment litigation issues include discrimination based on one or more protected categories (age, race, gender, national origin, pregnancy, disability, height and weight, marital status, religion, and/or sexual orientation); harassment based on one or more protected category; medical leave concerns; retaliation; and other unlawful changes in the terms and conditions of the employment relationship. Employers also may find litigation necessary to protect their trade secrets or enforce non-compete agreements.

Employment Contracts And Other Agreements

While the general rule in Michigan is that all employees are employed on an “at-will” basis, employers and employees are free to contract regarding certain terms and conditions of the employment relationship, or termination of the relationship. These may include employment agreements; severance agreements; executive compensation; “buy-sell” agreements with shareholders; non-competition agreements; and non-solicitation agreements. It is important to have a contract reviewed by legal counsel before you sign; any time you believe a party has violated a contract; or as your situation changes so you can understand your rights and responsibilities.

Human Resources Advice And Counsel

A human resources department is tasked with applying state and federal laws as well as company procedures to everyday situations. They are also often the main contact for employees who call in sick or need help with the employee’s very personal situations. At Myers & Myers, we serve as general counsel for employers of all sizes. We can also provide one-time services for our corporate clients, as needed. Our attorneys also help employers navigate the complex and frequently changing requirements due to the COVID-19 pandemic – including ongoing OSHA requirements and guidelines for employers.
